Be Heard Privacy Policy

Unum ID, Inc. ("Be Heard" or "we") respects your privacy and is committed to protecting it through our compliance with this privacy policy ("Privacy Policy"). This Privacy Policy describes the types of information we may collect from you or that you may provide when you create your login ID, use the Be Heard browser extension that allows you to share your social media posts with your representatives in government ("Extension"), and use the Be Heard website at https://www.WeShouldBeHeard.org/ ("Site") (collectively "Be Heard Services") and our practices for collecting, using, maintaining, protecting, and disclosing that information. This Privacy Policy is a part of, and is incorporated into, the Be Heard Terms of Service ("Terms") located at www.WeShouldBeHeard.org/Terms-of-Service.html.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. BY ACCESSING OR USING THE Be Heard SERVICES YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY AND YOU EXPRESSLY CONSENT TO THE COLLECTION, USE, MAINTENANCE, AND DISCLOSURE OF YOUR INFORMATION, INCLUDING PERSONALLY IDENTIFIABLE INFORMATION (AS DEFINED IN SECTION 1.1) IN ACCORDANCE WITH THIS PRIVACY POLICY. If you do not agree to these policies and practices, do not install or use the Be Heard Services.

  1. Types of Information We Collect About You. We collect both Personal Information and Anonymous Information, each as defined below, in connection with your use of the Be Heard Services. Information that is not Personal Information or Anonymous Information is governed by the Terms.
    1. Personal Information. "Personal Information" is information which may be used to identify or contact an individual, such as your name, home address, or email address. You may be asked to provide this information when registering for a login ID on the Site, when using the Be Heard Services, and when communicating with us in connection with the Be Heard Services.
    2. Anonymous Information. "Anonymous Information" is information we collect in connection with your use of the Be Heard Services that is not associated with or linked to your Personal Information and which, on its own, does not individually identify you.
  2. How We Collect and Use Information.
    1. Information You Provide. In order to use the Be Heard Services you must provide Be Heard with Personal Information such as your name, email address, and home address to create your login ID. Be Heard uses this information to create your login ID, ensure the security of your account, connect you to your representatives, and to communicate with you via email. If you provide Personal Information or other information to be published or displayed on public areas of websites or services, you do so at your own risk. We cannot control the actions of other users of websites or services who may view your public post. Therefore, we cannot and do not guarantee that your post will not be viewed by unauthorized persons. Be Heard may use your information to provide the Be Heard Services, to fulfill any other purpose for which you provide it, and to carry out our obligations and enforce our rights.
    2. Information Collected Automatically When Using the Be Heard Services. We automatically collect certain information about how you use and interact with the Be Heard Services like your IP address, browser type, the domain names visited, and access times. Be Heard uses session cookies and persistent cookies to identify that you have logged into the Be Heard Services. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain features of the Be Heard Services. Some portions of the Be Heard Service or our email correspondence may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Be Heard to count users who have opened an email and for other related Site or Extension statistics (for example, recording the popularity of certain content and verifying system and server integrity) and for other analytics. We use this information to improve our software and operations, improve content, insert the Be Heard user interface when appropriate, and to customize the Be Heard Services for you.
    3. Feedback. If you provide us feedback or contact us via email, we will collect your first name, last name, email, and any feedback you provide. Any feedback you provide us will be governed by the Terms and this Privacy Policy. We may use the Personal Information you provide in feedback to contact and respond to you.
    4. Anonymous Information Generally. We may create Anonymous Information records from Personal Information by excluding information (such as your name) that would otherwise make such data personally identifiable to you. We may use Anonymous Information at our discretion and for any purpose.
  3. How We Share Information.
    1. At Your Request. We may use information about you to fulfill the purpose for which you provide it. For example, if you give us a post to submit to a website, we will transmit the contents of that post to the website. For more information on how websites or services use your information, please review their privacy notices.
    2. Our Service Providers. We employ third-party companies and individuals to administer and provide services on our behalf (including, but not limited to, a cloud service provider) who may need your information to provide services for us. These third-party service providers are restricted from using your Personal Information for any purpose other than to provide the services requested by Be Heard. When you use the Extension on websites or services, these websites or services are not our third party service providers and we cannot control how they use the information you post on or to their websites or services.
    3. Other Disclosures. Regardless of any choices you make regarding your Personal Information, we may disclose your Personal Information: (i) to respond to subpoenas, warrants, court orders, lawful requests, or legal process, (ii) to establish or exercise our legal rights or defend against legal claims, or protect other users, (iii) in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, or as otherwise required by law, or (iv) to investigate, prevent, or take action regarding any violation of this Privacy Policy or the Terms.
    4. Business Transfers. We may transfer your Personal Information in the event of a merger, acquisition, reorganization, sale of assets, or in the event of bankruptcy. We may also share your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under common control that we may have now, or in the future, in which case we will require them to honor the terms of this Privacy Policy.
    5. Anonymous Information. We may disclose Anonymous Information about our users without restriction.
  4. Accessing and Correcting Your Information. You can review and change your Personal Information by logging into the Be Heard Services and visiting your account profile page.
  5. Data Security. We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through the Be Heard Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Be Heard Services or third party websites or services.
  6. Children Under the Age of 13. The Be Heard Services are not intended for children under 13 years of age. No one under age 13 may provide any Personal Information to or through the Be Heard Services. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on or through the Be Heard Services. If we learn we have collected or received Personal Information from a child under 13, we will delete that information.   7. Third-Parties. Any third-party websites, products and services (collectively "Third-Party Services") are managed by those third-parties. The presence of a link to Third-Party Services does not constitute an endorsement, authorization, or representation that we are affiliated with the Third-Party Services. We do not exercise control over Third-Party Services and Third-Party Services are governed by their own privacy policy. We encourage you to read the privacy policy and terms of use for these Third-Party Services before you choose to utilize them.
  8. How We Respond to Do Not Track. The Extension and the Site do not respond to Do Not Track signals.
  9. Changes to Our Privacy Policy. It is our policy to post any changes we make to this Privacy Policy on this page. If we make material changes to how we treat our users' Personal Information, we will notify you by email to the email address specified in your login ID and through a notice on the Site home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Privacy Policy to check for any changes.
